Under Iowa law, if the workers compensation claim is admitted, then the employer and employer’s insurance carrier control the doctors that an employee sees. This does not mean that the employer or the employer’s insurance carrier controls the medical care that the doctor provides.
If an employee with an admitted workers compensation claim goes to their own doctor and submits it to the employee’s insurance carrier, it is possible that the employee’s health insurance would pay for that cost. However, it is also possible that the employee would remain responsible for the costs.
If the workers compensation claim is denied, then the employer or the employer’s insurance carrier do not control the medical care or the doctors that an employee sees. In situations where an employee’s workers compensation claim is denied, the employee can see their own doctor and submit their medical bills to their own health insurance provider.
